Elgin man gets 12-year prison term for child sex assault — sixth Elgin resident convicted of such a crime in Kane since March 2024

An Elgin man was given a 12-year prison sentence after admitting he sexually assaulted a child, according to the Kane County State’s Attorney’s Office.

Jose F. Molina-Acevedo, 45, pleaded guilty to one count of predatory criminal sexual sssault of a child, class X felony, in exchange for the prison term under a plea deal accepted by Kane County Judge David Kliment, a news release said.

He was the sixth Elgin resident to be convicted of sexual assault or abuse of a child in Kane County since March 2024, records show.

Prosecutors said Molina-Acevedo sexually abused the victim, who was under the age of 13, by touching the child under clothing on occasions between Jan. 1, 2021, and May 27, 2023, the release said.

Under state law, Molina-Acevedo must serve at least 85% of the sentence and will serve a mandatory term of supervised release of anywhere between three years and life as determined by the Prisoner Review Board. He also must register as a sex offender for the rest of his life, the release said.

“Thank you to the multidisciplinary team at the Kane County Child Advocacy Center — especially Investigator Ruzevich, whose hard work allowed us to secure this conviction without putting the child through the trauma of testifying against their abuser, and Child Advocate Cali Stephenson,” Assistant State’s Attorney Morgan Wilkinson said in a statement.

“Most importantly, thank you to the victim in this case for demonstrating tremendous bravery in telling what happened to them, ensuring it won’t happen to anyone else.”

The Kane County State’s Attorney’s Office has convicted several Elgin residents of sexual assault and abuse charges involving children 13 or younger since March 2024. They include:

  • Jacob R. Gutierrez, 35, convicted on four counts of predatory criminal sexual assault and two counts of aggravated criminal sexual abuse of a girl under the age of 13 in January following a bench trial. Sentencing is pending.
  • Ernesto Velasquez-Jimenez, 36, sentenced to 49 years in prison in December 2024 after being found guilty of three counts of predatory criminal sexual assault of a child, a class X felony, and seven counts of aggravated criminal sexual abuse of a child, a class 2 felony, involving a child 13 or younger.
  • Maricela Garcia, 37, sentenced to six years in prison in December after being found guilty in an October 2024 bench trial of predatory criminal sexual assault of a child, a class X felony; aggravated battery of a child, a class 3 felony; and misdemeanor domestic battery.
  • Magdiel Perez, 27, sentenced to eight years in prison in June 2024 after being convicted of two counts of felony sexual assault criminal following a bench trial. The victim was a student at a middle school where he was employed.
  • Joel Rivera, 44, pleaded guilty to three counts of predatory criminal sexual assault of a child in connection with multiple incidents that occurred over the course of three years. He was sentenced to 27 years in prison in March 2024.
