A Gary man faces charges after taking a cop’s gun and shooting at him during an arrest for punching his dad.
Tracell Britton, 33, was charged on Dec. 28 with attempted aggravated battery, disarming a law enforcement officer, battery by means of a deadly weapon, three counts of resisting law enforcement, one count of intimidation and an additional misdemeanor.
He is in custody, held on a $100,000 or $10,000 cash surety bond. His next court appearance is on Jan. 9 before Judge Natalie Bokota.
Gary Police responded just before 1 p.m. on Dec. 27 to the 4000 block of Buchanan Street.
After taking a report from Britton’s dad, the officer saw Britton walking two blocks away around 1:42 p.m. near 41st Avenue and Johnson Street.
Britton ignored his commands, fought the officer on the ground, and partly pulled out the gun from his holster, firing one round. It grazed the cop’s boot.
The officer’s hands were bleeding, bruised and swollen from the fight, charges state. Another officer who responded for backup had a cut pinky.
During the altercation, police officers said Britton said he would “kill” them and they should “just die”, charges state.
It was unclear if there was camera footage.
Officers had responded on Dec. 23 to the same house after Britton got into it with his 64-year-old father. His family asked cops to kick him off the property.
The father called police again that day when Britton came back and walked into the unlocked garage.
They argued, then Britton punched him in his face, charges state.
The brother, who was home, fired a warning shot before Britton ran away.
