A homeless man who fired several shots at Elgin police with an illegal gun in 2023 has been sentenced to 15 years in prison, according to the Kane County State’s Attorney’s Office.
Odessian T. Torres, 30, pleaded guilty to one county of aggravated discharge of a firearm at police officers, a class X felony, in exchange for the prison term in a deal accepted by Kane County Judge John Barsanti.
The incident occurred Sept. 9, 2023, when Torres used a 9mm handgun to shoot at police and also fired three shots at a city-owned stop sign, a state’s attorney’s office news release said. As a convicted felon, he was prohibited from having a gun, officials said.
Torres must serve at least 85% of the sentence under state law, and will receive credit for 525 days served in the Kane County jail while waiting for the case to be resolved.
“This sentence reflects the seriousness of knowingly firing a weapon at law enforcement officers, and it ensures accountability for such actions,” Assistant State’s Attorney Kelly Orland said in a statement. “(The Elgin Police Department’s) swift response and commitment to justice were critical in bringing this case to a resolution.”
