The Kane County State’s Attorney’s Office and law enforcement agencies will conduct a “no refusal” DUI patrol Tuesday evening, which is New Year’s Eve, and into the early hours of New Year’s Day, officials said.
The anti-DUI effort will start at 11 p.m. Tuesday and end at 3 a.m. Wednesday, according to a press release from the Kane County State’s Attorney’s Office.
No-refusal operations are designed to assist police efforts to obtain a search warrant for individuals who refuse to submit to chemical testing after a DUI arrest, the release said.
Kane County assistant state’s attorneys will be on hand during the effort to assist police officers through the search warrant process to compel a DUI suspect to submit to a lawfully requested blood, breath or urine test as required by Illinois law, officials said.
Illinois courts have held that a person has no right to refuse chemical testing when probable cause exists, according to the release.
Anyone who declines to submit to chemical testing after being presented with a search warrant should expect to face additional charges, according to the release.
The operation will be the 38th no-refusal anti-DUI event since the Kane County State’s Attorney’s Office began the program in 2008, officials said.
Officials said that designated drivers, taxis, Uber and Lyft are all options for getting home responsibly on New Year’s Eve.
