A man from North Aurora recently pleaded guilty to driving under the influence after he crashed into and killed a motorcyclist in 2023, officials announced Monday.
Luis Aca Osorio, 40, has agreed to a sentence of eight years in state prison in exchange for a guilty plea to the offense of driving under the influence of alcohol – causing death, which is a Class 2 felony, according to a news release from the Kane County State’s Attorney’s Office.
He received credit for the 24 days he has already served in the Kane County jail, the release said.
Officials said in the release that, on May 7, 2023, at around 5 p.m., Osorio was driving a van in Batavia when he rear-ended a motorcyclist who was driving in front of him. The driver of the motorcycle was pronounced dead as a result of the injuries he sustained from the crash, the release said.
Osorio stopped a short distance away from the crash, where he was located by officers, according to the release. He submitted to a chemical breath sample, officials said in the release, which showed his breath alcohol concentration to be 0.204, more than twice the legal limit.
